Jonathan O’Dea, the Member for Davidson, says a recent media story highlighting the dangers of Residential Cost Plus Building Contracts (RCPBC) has created Ministerial interest that he hopes will assist a devastated Lindfield family that cannot even secure their home. 

“Kevin and Karen Roche signed a building contract in good faith as they saw the Master Builders Association logo (MBA) and thought they would be adequately protected. The MBA has admitted the RCPBC favours builders. It is my understanding the MBA is also examining the use of an out of date contract by the builder,” Mr O’Dea said.
“As the matter rests, the builder is now saying he wants another $260,000 to complete the job. However there are many defects in workmanship that should be fixed before any future work can be properly considered.

“With their savings completely depleted, the family recently sold their large near new four-wheel drive vehicle just to stay afloat financially. They may have to sell their daughter’s car next – an 18th birthday present.

“I am hoping that the Fair Trading Minister’s personal attention will help ensure the family can have their home completed before the real cold of winter sets in.

“The NSW Government must immediately consider the use of Residential Cost Plus Building Contracts and introduce appropriate restrictions before more families are left in a similar situation. The use of RCPBCs has already been regulated in Queensland and Victoria.”
